Deposit lease

You may deposit lease if you believe that you are entitled to a deduction of the lease fee. Apply for a deposit of lease with the County Administrative Board.

If you believe that you are entitled to a deduction of the lease fee, you have the opportunity to deposit the deducted amount with the County Administrative Board. By depositing with us, you may avoid losing your right to continue the lease by reason of not paying the fee on time.

What is required for a lease deposit?

As a leaseholder you have the opportunity to deposit the lease fee if you believe that you:

  • are entitled to a fee deduction under any provision of the Land Code,
  • are entitled to compensation for damages under the Land Code,
  • are entitled to compensation for having paid for corrections or repairs at your own expense,
  • have a financial counterclaim on the property owner, regardless of the nature of the counterclaim, or
  • are disagreeing with the landlord on the amount of the lease fee and the amount is not specified in the lease agreement.

The advantage of making a lease deposit with the County Administrative Board, compared to just refraining from paying, is that the property owner cannot claim that you, by not paying the fee, forfeited your leasehold right. However, you may lose your leasehold right if you deposit a too large amount of the fee, for example, if you deposit the full lease fee although only a twentieth of the lease grounds has deteriorated after, for example, a landslide. Your leasehold right may also be forfeited if you make the deposit after the fee’s due date.

How do I make a lease deposit?

A lease deposit application consists of three parts. You send the application to the County Administrative Board, you pay the amount you want to deposit and, finally, you pay a security. We cannot process the deposit application if one of these parts is missing.

Pay the amount you want to deposit to the County Administrative Board. You decide how much to deposit.

At the first payment – please provide your corporate number, or social security number, and your name in the payment notification box (for example, “012345-6789, Company Ltd., Your Name”).

If you wish to continue to deposit the lease – please provide expiration date, the case number that was given to you at the first deposit and the amount of the security deposit in the payment notification box (for example, “October 1st, 208-2010-300, security deposit 10 000).

Pay a security to deposit

To be able to deposit money with the County Administrative Board, you as a tenant have to pay a security in the form of a pledge or guarantee. The security must cover any litigation costs as well as interest on overdue payment if, according to the court, the property owner is entitled to the deposited amount. 

If we decide to accept your lease deposit, we will notify the property owner that you decided to deposit the entire lease fee, or parts of the fee, with us.

Reimbursement

You are entitled to a reimbursement of the deposited amount if you and the property owner agree.

The reimbursement application must be in the original and it must be signed by the person who wants the money.
